These Terms of Service (“Terms”) govern your use of the suite of utility applications published by Intallaga Tech Pty Ltd, trading as Amma AI (“Amma AI”, “we”, “us”, “our”) under the “Amma” brand, including but not limited to: Amma SuperOCR, Amma Record, Amma LingoOCR, Amma Bookkeeper, Amma WordsCard, Amma Scanner, Amma WooTalk, and Amma CatMeow (collectively, “the Tools”). By downloading, installing, or using any Tool, you agree to these Terms.
These Terms do not apply to Amma SAT, which has its own Terms of Service.
1. The Tools
The Amma Tools are standalone utility applications designed to perform specific tasks as described by their names and App Store listings — such as optical character recognition, document scanning, voice recording, flashcard creation, expense tracking, and similar functions. The Tools are provided for personal, lawful use.
2. Your Responsibilities & Acceptable Use
You agree to use the Tools only for lawful purposes and in accordance with all applicable laws and regulations. Specifically, you agree not to:
- Use any Tool to process, create, store, or distribute content that is illegal, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable under any applicable law.
- Use OCR, scanning, or recording tools to capture, reproduce, or distribute copyrighted material without authorisation from the rights holder.
- Use recording or transcription tools to record conversations without the consent of all parties where required by law (many jurisdictions require all-party consent).
- Use any Tool to infringe upon the intellectual-property rights, privacy rights, or other legal rights of any person.
- Use any Tool for fraud, identity theft, phishing, or any other deceptive or criminal activity.
- Use any Tool to stalk, harass, or harm another individual.
- Reverse-engineer, decompile, disassemble, or attempt to extract the source code of any Tool.
- Circumvent, disable, or interfere with any security features or usage limitations.
You are solely responsible for the content you create, process, or store using the Tools and for ensuring your use complies with all applicable laws in your jurisdiction.
3. No Warranty on Output Accuracy
The Tools use on-device processing (including OCR, speech recognition, and other automated features) that may produce inaccurate, incomplete, or erroneous results. You acknowledge that:
- OCR output may contain errors, especially with handwritten text, poor-quality images, or complex layouts.
- Transcription output may contain errors, especially in noisy environments or with accented speech.
- Translation output (where applicable) is approximate and should not be relied upon for legal, medical, or other critical purposes.
- You should independently verify any output before relying on it for important decisions.
4. Content You Create
- You retain full ownership of all content you create, scan, record, or process using the Tools.
- Since the Tools operate on-device and we do not access your content, we claim no rights over it.
- You are responsible for backing up your own content. We are not liable for data loss caused by device failure, accidental deletion, or any other cause.
5. Purchase & Licence
- Each Tool is available as a one-time purchase through the Apple App Store. Once purchased, you receive a perpetual, non-transferable licence to use the Tool on your Apple devices.
- There are no subscriptions, recurring fees, or in-app purchases. You pay once and use the Tool forever.
- Payment is processed entirely by Apple and is subject to Apple’s terms and refund policies. We do not process payments directly.
6. Intellectual Property
- The Tools, including their design, code, icons, and branding, are owned by or licensed to Amma AI and are protected by intellectual-property laws.
- You may not reproduce, distribute, modify, or create derivative works from any Tool.
- “Amma” and the Amma AI logo are trademarks of Intallaga Tech Pty Ltd.
7. Disclaimer of Warranties
To the maximum extent permitted by applicable law, the Tools are provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory. We disclaim all warranties, including but not limited to:
- Merchantability and fitness for a particular purpose.
- Accuracy, reliability, or completeness of any output or processed content.
- Uninterrupted or error-free operation.
- Compatibility with all devices or operating-system versions.
8. Limitation of Liability
To the maximum extent permitted by applicable law:
- Amma AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of (or inability to use) any Tool.
- This includes, without limitation, damages for loss of data, loss of profits, loss of business opportunities, personal injury, property damage, or any other losses arising from your use of the Tools or reliance on their output.
- Our total aggregate liability for any claim shall not exceed the amount you paid for the specific Tool in the 12 months preceding the claim, or USD $50, whichever is greater.
Important: We are not responsible for any harm, loss, legal liability, or consequences that result from how you use the Tools or the content you create with them. You use the Tools at your own risk.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including under the Australian Consumer Law.
9. Indemnification
You agree to indemnify, defend, and hold harmless Amma AI and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from:
- Your use of any Tool in violation of these Terms or applicable law.
- Content you create, process, record, or distribute using any Tool.
- Your violation of any third-party rights (including intellectual-property, privacy, or publicity rights).
- Any illegal, harmful, or detrimental activity conducted using any Tool.
10. Termination
Since most Tools do not require accounts, “termination” effectively means uninstalling the Tool. We reserve the right to discontinue any Tool at any time. If a Tool includes account-based features, we may suspend or terminate your access for violation of these Terms.
11. Governing Law & Dispute Resolution
- These Terms are governed by the laws of the State of New South Wales, Australia.
- Disputes shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to the jurisdiction of the courts of New South Wales, Australia.
- Nothing in this clause limits your statutory rights under consumer-protection laws in your jurisdiction.
12. Changes to These Terms
We may update these Terms from time to time. Changes will be reflected in the “Last updated” date above. Material changes will be communicated through the relevant app or our website. Continued use of any Tool after changes constitutes acceptance.
13. Severability
If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full force and effect.
