These Terms of Service (“Terms”) govern your access to and use of the Amma SAT application (“the App”) operated by Intallaga Tech Pty Ltd, trading as Amma AI (“Amma AI”, “we”, “us”, “our”). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
1. Eligibility
- You must be at least 13 years old to use the App. Users under 13 require verifiable parental consent in compliance with COPPA.
- If you are between 13 and 18 (or the age of majority in your jurisdiction), you confirm that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.
- In the EEA/UK, users under 16 require parental or guardian consent under the GDPR.
2. The Service
Amma SAT is an AI-assisted SAT preparation application that provides:
- Personalised study plans generated based on your profile, test date, and performance data.
- Practice tests modelled on the Digital SAT format.
- AI-powered tutoring explanations (the “Amma AI Tutor”).
- Vocabulary training with spaced repetition.
- Bundled SAT prep textbooks and literature.
3. Accounts
- You must provide accurate information when creating an account.
- You are solely responsible for maintaining the confidentiality of your account credentials.
- You must notify us immediately at hi@intallaga.com if you suspect unauthorised access to your account.
- One account per person. You may not share, sell, or transfer your account.
4. Subscriptions & Payments
- The App offers a free tier with limited AI usage, and paid subscription tiers (Basic and Pro) with expanded features.
- All subscriptions are billed through Apple’s In-App Purchase system. Payment is charged to your Apple ID at confirmation.
- Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current billing period.
- You can manage or cancel subscriptions in your device Settings > Apple ID > Subscriptions.
- Refunds are governed by Apple’s refund policies. We do not process payments directly and cannot issue refunds outside Apple’s system.
- We reserve the right to change pricing with reasonable advance notice. Price changes do not affect the current billing period.
5. AI-Generated Content — Important Disclaimer
The Amma AI Tutor provides educational guidance only. While we strive for accuracy, you acknowledge and agree that:
- AI-generated explanations, study plans, and recommendations may contain inaccuracies, errors, or omissions.
- The App does not guarantee any specific SAT score improvement or test outcome.
- AI content is not a substitute for professional academic counselling, tutoring, or school-based educational guidance.
- You should independently verify important information, especially for high-stakes decisions.
- We are not liable for academic outcomes, college admissions decisions, or any consequences arising from reliance on AI-generated content.
6. Acceptable Use
You agree not to:
- Use the App for any unlawful purpose or in violation of any applicable law or regulation.
- Attempt to gain unauthorised access to the App, other user accounts, or our systems.
- Reverse-engineer, decompile, or disassemble any part of the App.
- Scrape, harvest, or systematically extract data or content from the App.
- Use the AI Tutor to generate content that is harmful, abusive, hateful, discriminatory, defamatory, or violates the rights of others.
- Redistribute, resell, or commercially exploit App content (including practice tests, textbooks, and AI-generated explanations) without our written permission.
- Use the App to facilitate academic dishonesty, including cheating on actual SAT examinations or submitting AI-generated work as your own in academic settings.
- Circumvent usage limits, subscription restrictions, or any security measures.
- Upload malicious files, viruses, or harmful code.
7. Content You Provide
- You retain ownership of content you upload (e.g., custom tests, documents, images).
- By uploading content, you grant us a limited, non-exclusive, royalty-free licence to process it within the App solely for your personal use.
- You represent that you have the right to upload any content you provide and that it does not infringe third-party rights.
- We may remove content that violates these Terms or applicable law.
8. Intellectual Property
- All content, design, code, branding, practice tests, textbooks, and AI-tutor technology in the App are owned by or licensed to Amma AI and are protected by copyright, trademark, and other intellectual-property laws.
- You may not reproduce, distribute, modify, or create derivative works from the App or its content.
- “Amma”, “Amma SAT”, “Amma AI”, and the Amma AI logo are trademarks of Intallaga Tech Pty Ltd.
9. Limitation of Liability
To the maximum extent permitted by applicable law:
- The App is provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
- We do not warrant that the App will be uninterrupted, error-free, secure, or that defects will be corrected.
- Amma AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, academic opportunities, or goodwill, arising from your use of (or inability to use) the App.
- Our total aggregate liability for any claim arising out of or relating to the App or these Terms shall not exceed the amount you paid to us for the App in the 12 months preceding the claim, or USD $100, whichever is greater.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including under the Australian Consumer Law.
10. Indemnification
You agree to indemnify, defend, and hold harmless Amma AI and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from:
- Your use of the App in violation of these Terms.
- Content you upload or create using the App.
- Your violation of any applicable law or third-party rights.
11. Suspension & Termination
- We may suspend or terminate your access at any time if you violate these Terms, with or without notice depending on the severity.
- You may delete your account at any time from within the App’s Profile section or by emailing hi@intallaga.com.
- Upon termination, your right to use the App ceases immediately. Provisions that by their nature should survive (including Limitation of Liability, Indemnification, and Governing Law) will survive termination.
12. Governing Law & Dispute Resolution
- These Terms are governed by the laws of the State of New South Wales, Australia, without regard to its conflict-of-law provisions.
- Any dispute arising from these Terms or your use of the App shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to the jurisdiction of the courts of New South Wales, Australia.
- Nothing in this clause limits your right to bring proceedings in your local jurisdiction where required by applicable consumer-protection law (including EU consumer rights).
13. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated via the App or email at least 14 days before taking effect. Continued use of the App after changes take effect constitutes acceptance of the revised Terms. If you do not agree to the changes, you should stop using the App and delete your account.
14. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
15. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Amma AI regarding the App.
